TERMS AND CONDITIONS OF SALE
Article 1 - Scope - Conditions
The purpose of the present conditions is to define the rights and obligations of the parties as well as the terms and conditions within the framework of the online sale or on site at the head office of the company SAVOIE PARACHUTISME, for solo or tandem skydiving services.
They are reserved solely for consumers, within the meaning of the law and case-law, acting exclusively on their own account.
Article 2 - Definition of terms used
The term "the conditions" refers to these general terms and conditions of sale.
The term "the seller" refers to the company SAVOIE PARACHUTISME, a limited liability company with a capital of 43 500€, whose head office is at Chambéry-Aix les bains 73420 Le viviers du lac, registered in the Trade and Companies Register of CHAMBERY (SAVOIE) under the number : 482 114 972.
The term "customer" refers to a natural person who purchases a gift voucher or gift certificate for his or her own account or for the benefit of another person (the beneficiary).
The term "service" refers to the content of the service (individual parachute jump or tandem jump or freefall initiation jump or PAC) purchased by the customer whether for his own account or for that of a third party.
The term "gift voucher" refers to a full tandem jump or freefall initiation jump or CAP course.
The term "gift voucher" refers to a participation of an amount freely chosen by the client to be used for a service that will then be chosen by the beneficiary.
Article 3 - Consumer information - Acceptance of the general terms and conditions.
In accordance with the provisions of Articles L.111-1 and L.111-4 of the French Consumer Code, the essential characteristics and prices of services sold electronically are available on the website and at the Company's registered office.
The customer declares to have read the general terms and conditions of sale before validating his order within the meaning of Article 5 below, whether on site or through the website.
The validation of the order (on the spot or online) is thus worth acceptance without restriction or reserve of the present general conditions of sale.
Article 4 - Order and conclusion of the sale
If the sale takes place directly on site at the company's headquarters, the seller will fill out the gift voucher or gift certificate form in the presence of the buyer (or the beneficiary if it is on his behalf). The buyer will have to validate the order by acknowledging that he has taken knowledge of the general conditions of sale (displayed on the premises).
As the reception is not open every day from mid-November to the end of March, on-site purchases can only be made by appointment.
The payment of any purchase directly in our premises can be made by :

If the buyer places an order via the website, he will have to follow the instructions on the site, fill in the order form, it being specified that in case of prolonged inactivity of the connection, it is possible that the selection of the service chosen by the customer before this inactivity, is no longer guaranteed.
The buyer is then invited to start his selection from the beginning.
The buyer must check the elements of the order and if necessary identify and correct any errors beforehand, then validate the order and ensure payment by the means provided on the site.
The buyer shall then receive an electronic confirmation of acceptance of payment and order confirmation without delay.
The gift voucher (or gift certificate) will arrive within a maximum of 48 hours in high season. Or more in low season. (Sometimes the emails go to the undesirable ones. Remember to look at them).
Article 5 - Prerequisites for the performance of benefits
The seller markets and provides solo or tandem parachute jumps which are activities governed by specific safety rules.
In order for the purchased service to be carried out, the following conditions must be imperatively respected by the customer and/or the beneficiary:
If the service purchased by the client is intended for a third party, the client must first make sure that the latter wants to make the jump and that he fulfils the conditions below; otherwise, no reimbursement of the voucher or gift certificate will be made.
The beneficiary, on the day of the jump, must have a valid medical certificate of "fitness for skydiving" (valid for 1 year).
Be at least 15 years of age and have written permission from the parents.
We take people who are max 85kg (not dressed). If the person is over 85kg please let us know his or her height to see if we can take him or her or refer you to another school.
Look out! If we have doubts about the weight indicated on the form filled in on the day of the jump; we give ourselves the right to weigh the person and to refuse him/her if the weight indicated does not correspond to what was mentioned on the form. No refund possible.
No jump will be allowed if the above conditions are not met.
Article 6 - Making the jump
The beneficiary of a voucher or a gift voucher must be able to communicate on the day of the jump, the information necessary to identify the voucher or gift voucher.
Only the presentation of the voucher or gift certificate or its identification number will allow you to benefit from the service. The performance of the service will be checked and validated beforehand by the seller.
The seller reserves the right to refuse the jump to the client and/or beneficiary if he does not respect the safety instructions previously communicated to him by an instructor or an authorized person in charge or if he is obviously intoxicated or under the influence of drugs.
In the event that the client and/or beneficiary is refused the jump for the reasons set out above or if he himself refuses to make the jump, two cases are possible:
If the person has not boarded the plane, the sum of 50€ will be retained by SAVOIE PARACHUTISME, the balance will be refunded by cheque or bank transfer.
If the person gets on the plane but is refused to jump by the instructor because of his behaviour and in particular because of non-compliance with the safety instructions or if he refuses to jump himself; the sum of 100€ will be retained by SAVOIE PARACHUTISME and the balance will be refunded by cheque or transfer.
Article 7 - Weather report
If a postponement due to weather conditions takes place with a gift voucher to be made during the week, another date will also be proposed during the week. However, if the customer wishes to skip the weekend or public holidays, he will have to pay the difference between the two rates. Conversely, a "weekend" gift voucher postponed or made during the week, will be accompanied by a refund of the difference.
Article 8 - The video option
The price of the service is displayed on the premises and on the website. This service, if not included in a gift voucher will have to be paid before the jump.
The customer and/or the beneficiary will be able to reserve a video option. This option will have to be made at the time of the appointment or at the latest 48 hours before the jump (by phone or email).
In the case of a video option requested on the day of the jump, the seller reserves the right not to be able to perform this service.
The video service will be fully refunded if there is no image of the part in free fall.
The video performance will be refunded to 50%, if only part of the freefall and landing is missing.
NO REFUND WILL BE MADE IF ONLY THE FILES OTHER THAN THOSE CONCERNING FREEFALL AND LANDING ARE MISSING.
In any case, the tandem jump, will not be subject to any refund or reduction.
Article 9 - Loss - Theft of Gift Vouchers or Vouchers
In case of loss or theft, during its period of validity, the beneficiary will have to provide the name of the buyer and the date of purchase of the voucher (at least the year) so that the seller can issue a new voucher with the same validity as the original one.
If the beneficiary or the buyer is not able to provide the necessary information, the gift voucher or gift certificate can neither be used, nor reimbursed, nor even be subject to any extension.
Article 10 - Validity of vouchers and gift certificates - Deferrals
Vouchers and gift vouchers are valid for two seasons from the date of purchase or according to the opening and closing dates of SavoieParachutisme, being reminded that the season starts around the beginning of April and ends at the beginning of November. (Calendar on line during January).
The client or the beneficiary of a voucher or gift certificate may request a postponement, without surcharge, but only for medical reasons and with the production of a medical certificate of contraindication and not exceeding the validity date of the voucher or gift certificate.
Requests for postponement not related to a medical reason, must be made by email before the end of the validity of the voucher or gift voucher for the following costs:
- 30€ fee for an extension of 3 months from the expiry date of the voucher or gift certificate.
- 60€ fee for an extension of 6 months from the end of validity of the voucher or gift certificate.
ONLY ONE POSSIBLE DEFERRAL
Article 11 - Right of Withdrawal
The customer, and he alone, has a right of retraction that he can exercise within 14 calendar days following the date of receipt of the order confirmation email.
If this period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended to the first following working day.
The customer who wishes to exercise his right of retraction must send his request by email to contact @ savoieparachutisme.com.
Article 12 - Reimbursement on medical grounds
In the event of an unfavourable opinion to the realization of a jump by the beneficiary, by means of the production of a medical certificate of contraindication, the client who purchased the gift voucher or gift certificate will benefit from the full reimbursement of the amount paid on the day of acquisition. The voucher or gift certificate can be refunded to the beneficiary (instead of the buyer).
The request must be made in writing (email or postal mail), or hand-delivered if necessary on our premises.
Provide in all cases :
- The medical certificate of contraindication (not exceeding the validity date of the voucher or gift certificate),
- The voucher or gift certificate
- A RIB if reimbursement by bank transfer. No cash refund.
Any request for reimbursement for medical incapacity must be made before the end of the validity of the voucher or gift certificate.
Article 13 - Gift vouchers offered by Savoie Parachuting
If the seller offers gift vouchers or gift certificates to companies, associations, lottery organizers, schools, raffles etc....no deferral or exchange in value is possible.
Beneficiaries of vouchers or gift vouchers offered by Savoie Parachutisme will have to fulfil the same obligations as a purchaser of vouchers or gift vouchers.
These vouchers are not nominative but are not resalable. The validity date is firm.
Requests for postponement or reimbursement for medical reasons are not applicable for this type of vouchers or gift certificates.
Article 14 - Practitioners - Prepaid jumps
Practitioners must settle their jumps at the end of each day or credit their accounts.
Accepted payments: cash - credit card - holiday cheques - bank transfer*.
Transfers are accepted only if they are made to credit the account (min. 200 €) and not to pay at the end of the jump day.
Attention: jump credits are valid for 2 seasons. After the date, the sums will remain acquired at Savoie Parachutisme. No refund will be accepted.
Article 15 - DPR
When making a purchase on the spot or via the website, a certain amount of information must be provided as it is necessary and indispensable for processing the purchase.
Failure to respond to a mandatory field may result in the request being rejected.
Pursuant to the provisions of European Union regulation n°2016/679 relating to the protection of individuals with regard to the processing of personal data and the free circulation of such data (RGPD) and law n°78-17 of 6 January 1978 and its implementing decree n°2005-1309 of 20 October 2005, as amended by the law of 2018-493 of 30 June 2018 and decree n°2018-687 of 1 January 2008, the following provisions of the French Data Protection Act (RGPD) have been applieder August 2018, of the order 2018-1125 of 12 December 2018 and of the decree n°2019-536 of 25 May 2019, the seller implements personal data processing concerning natural persons.
The data processing is only used to the extent necessary to contact the purchaser, to process the purchaser's requests, to create and manage the user profile, to create and manage online access.
Personal information is only kept for one month from the date of performance of the service or, from the end of the validity of the voucher if it has not been used.
The longer retention period of information is permitted or imposed by a legal or regulatory obligation.
During the entire period of holding the information, the seller shall put in place all necessary means to ensure the confidentiality and security of the personal data collected, so as to prevent their damage, deletion or access by unauthorised third parties.
Access to the Buyer's personal data is strictly limited to the Seller's staff and, where applicable, its subcontractors, who are subject to an obligation of confidentiality and may only use the personal data in accordance with contractual provisions and applicable legislation.
Apart from the cases set out above, the seller undertakes not to sell, rent, transfer or give access to third parties to the personal data collected without the prior consent of the purchaser, unless forced to do so for a legitimate reason such as a legal obligation, the fight against fraud or money laundering....
In accordance with the aforementioned legal provisions, the purchaser benefits from a right of access, rectification, portability and deletion of his data or limitation of the processing. The purchaser may also, for legitimate reasons, oppose the processing of data concerning him/her.
To exercise his rights, the purchaser must produce a valid identity document and exercise his rights by contacting the manager of the Selling Company whose contact details are indicated on the site.

Article 16 - Force Majeure
The performance by the seller of its obligations under this contract shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay its execution.
The seller will notify the customer of the occurrence of such a fortuitous event or force majeure within a period of time that may be a few weeks before the date of the event as well as the day before or the same day (aircraft breakdown, weather, airport closure etc..).
Article 17 - Prices
The price of each service sold on the website or live on site is indicated on the website and displayed in Savoie Parachutisme's premises. It may be subject to change during the season without notice.
At the time of the validation of the order, the price includes all taxes.
Any telecommunication costs incurred in accessing the site remain the exclusive responsibility of the customer.
The period of validity of the price offers is determined by the updating of the site.
In the case of an online purchase, the transaction is immediately debited to the customer's credit card after verification of the customer's credit card details, upon receipt of the debit authorization from the issuer of the credit card used by the customer. In accordance with Article L.132 of the French Monetary and Financial Code, the commitment to pay given by means of a bank card is irrevocable.
By providing his credit card information, the customer authorizes the seller to debit his credit card for the amount corresponding to the all-inclusive prices.
Article 18 - Mediation
Pursuant to Article L.612-1 of the French Consumer Code: "any consumer has the right to have recourse, free of charge, to a Consumer Ombudsman for the amicable resolution of a dispute between him and a professional".
Disputes falling within the scope of Article L.612.1 of the French Consumer Code are those referred to in Article L611-1 of the French Consumer Code, namely disputes of a contractual nature, relating to the performance of a contract of sale or supply of services, between a consumer and a professional.
The text covers national and international disputes.
These dispute settlements apply not only to direct sales on site but also via the website.
Pursuant to Articles L.616-1 0 L-616-3 AND R.616-1 of the Consumer Code, the professional must provide the consumer with the contact details of the consumer mediator(s) to whom he belongs, as well as the address of the mediator(s)' website, by entering this information legibly and visibly on his website; on the general terms and conditions of sale of services, on his order forms or on any other suitable medium.
Article 19 - Other provisions
The present general terms and conditions of sale form an indivisible contractual whole. They are governed by French law. Any dispute arising from the information, interpretation or execution of these general conditions of sale are the exclusive jurisdiction of the works.
In accordance with the provisions of the CNIL, you have the right to access and correct any information you may have entered on our online shop. You will be informed of this when you create your customer account.
